A liability insurance policy typically provides the insured with (1) an insurer-appointed attorney who will defend the insured during any covered lawsuits, and (2) payment for damages (indemnity) up to the policy's limits. The insured expects the insurer and its appointed defense attorney to join in a tripartite relationship, the focus of which is to defeat and/or lessen the insured's exposure.' In this respect, an insured can rely on the protection of a three-headed defense team. Some lawsuits, however, undermine the unity of the defense team and cause a breakdown in the tripartite relationship. These cases involve allegations that put the insurer's interests at odds with the insured's.
